BURNSVILLE, MN โ A 30-year-old Burnsville man, Dayon Daquon Presley, faces felony charges after allegedly breaking into vehicles, stealing a resident’s wallet, and using the stolen credit cards at a nearby grocery store. Presley was caught trespassing inside an apartment complex just hours after the initial theft.
According to Dakota County court records, Presley has been charged with felony Third-Degree Burglary and felony Financial Transaction Card Fraud. He remains held in the Dakota County Jail.
Tesla Security System Alerts Owner
The investigation began at approximately 11:23 p.m. on May 24, 2026, when Burnsville police officers were dispatched to an apartment complex on the 12300 block of Nicollet Avenue. A resident had reported suspicious activity after receiving an alert from her Tesla indicating someone was tampering with the vehicle.
Officers located Presley at the scene, matching the dispatcher’s description of a man wearing a white shirt, light gray shorts with compression leggings, and flip-flops. While Presley claimed he was visiting his girlfriend, he could not provide police with her name or any identifying details.
Captured on Security Cameras
A review of the apartment complex’s surveillance footage showed Presley inside the underground parking garage actively attempting to open the doors of several parked vehicles. At that time, officers issued him a citation for trespassing and released him.
Arrested Just Hours Later
At approximately 1:49 a.m. the same night, police responded to another trespassing complaint at a condominium building on Travelers Trail East. Officers located Presley inside the building and placed him under arrest.
During a search incident to his arrest, officers recovered a wallet containing six credit/debit cards belonging to another individual, along with four prepaid Mastercard gift cards valued at $50 each.
Stolen Cards Used at Local Grocery Store
Investigators tracked down the owner of the wallet, who resided at the same apartment complex where Presley was first stopped. The victim confirmed he had accidentally left his wallet inside his wife’s vehicle in the underground garage.
Police discovered that the stolen cards had been used between 1:03 a.m. and 1:10 a.m. to make unauthorized purchases totaling $240.32 at a nearby Cub Foods. The fraudulent transactions included groceries and the exact four $50 prepaid Mastercard gift cards found in Presleyโs possession.
Prior Conviction Elevates Charges
Because Presley was previously convicted of gross misdemeanor Financial Transaction Card Fraud in Dakota County in September 2023, prosecutors elevated the new card fraud charge to a felony.
He faces the following formal charges:

Presley also faces additional misdemeanor charges, including vehicle tampering, trespassing, and a separate property damage case.
Bail and Court Schedule
The court has set Presley’s bail at $20,000 without conditions, or $10,000 under strict release terms (including no contact with the victim, no trespassing, and a travel ban outside Minnesota). His next hearing for the burglary case is scheduled for July 29, 2026, in Hastings.
